Maine rules that catch people out

These come from questions learners find hardest. Each links to the page of the handbook it comes from.

  • The phone ban, midnight-to-5 a.m. curfew and passenger limits apply for 270 days after a driver under 18 passes the road test. Breaking them brings a license suspension and adds another 270 days to the restrictions.

Maine Driver's License Manual, page 9
  • Any violation of the under-18 restrictions results in a license suspension and a 270-day extension of the restrictions. The extension can even carry past the driver's 18th birthday.

  • A first license issued to someone under 21 is provisional for two years. A moving violation during that time brings a 30-day suspension, and second and third offenses bring harsher penalties.

  • Speeding by 30 mph or more over the limit is one of the convictions that can bring a 30-day suspension in Maine. Other offenses on the list include passing a stopped school bus with red lights flashing.

  • If you are found to have failed to produce evidence of insurance, you must file proof of financial responsibility through an SR-22 certificate or face suspension of your license and registration. Always keep current proof of insurance in the vehicle.

Maine Driver's License Manual, page 19
  • The Secretary of State's administrative suspension stays in effect even if the driver is later found innocent of OUI. It is based on the test result and police report, not the court verdict.

Maine Driver's License Manual, page 32
  • A first OUI conviction brings a license loss of at least 150 days, whether the alcohol level was 0.08-0.14 or higher. There is no work or limited license during the minimum suspension.

Maine Driver's License Manual, page 32
  • An OUI conviction at 0.15 or higher, or with aggravating factors such as speeding 30 mph over or a passenger under 21, brings at least 48 hours in jail, or 96 hours with a test refusal. Higher alcohol levels mean harsher penalties.
