South Dakota rules that catch people out
These come from the questions learners find hardest. Each links to the handbook page it comes from.
Minors normally hold the Instruction Permit for 275 days. Successfully completing an approved Department of Education driver education course, meaning a score of 80% or better on both the written and driving portions, cuts that to 180 days. The course has to be passed, not just attended.
South Dakota Driver License Manual, page 8South Dakota's 50 supervised hours must include 10 hours in inclement weather and 10 hours after dark. Snow, rain and darkness are common in the state, so the law makes sure new drivers practise in them with an adult beside them.
South Dakota Driver License Manual, page 8To get a Restricted Minor's Permit you must complete the Instruction Permit requirements, pass the driving test, and have no traffic violation convictions during the six months before you apply. A ticket can therefore delay your upgrade.
South Dakota Driver License Manual, page 8A first zero tolerance offense is a Class 2 misdemeanor punished by a fine and a 30-day loss of license. A second or later offense brings a 180-day loss. Drivers under 21 should simply never drink and drive.
South Dakota Driver License Manual, page 20A third DWI is a Class 6 felony, punishable by a fine, up to two years in prison, and loss of license for at least one year after release. Penalties climb sharply with each repeat offense.
South Dakota Driver License Manual, page 21Vision is impacted at 0.02% BAC for every driver, and vision is the most important sense used while driving. Alcohol blurs vision, slows focusing and makes it harder to judge distance and speed.
South Dakota Driver License Manual, page 20South Dakota does not assess points for speeding, standing, parking, equipment, or size and weight violations. That surprises many drivers, but speeding still brings fines, and other moving violations such as failing to yield do carry points.
South Dakota Driver License Manual, page 14When multiple offenses arise from a single incident, points are assessed only on the offense carrying the highest point value. This keeps one event from piling up points while still recording the most serious violation.
